Terms and Conditions

CERTAIN TERMS AND CONDITIONS GOVERNING THIS TRANSACTION AND THE SERVICES YOU HAVE SELECTED ARE SET FORTH BELOW.

This website is operated by Premier Advanced Financial Corporation II, a California corporation, dba "Advanced Financial Company" ("AFC"). By using the AFC Website, you ("You") agree to be bound by the following Terms and Conditions, as may be amended from time-to-time in AFC's sole discretion. AFC may amend these Terms and Conditions at any time by posting amended terms on the AFC Website, and all amended terms shall be effective immediately upon post to the Website.

PAYMENT BY CREDIT CARD. You must submit your payment by using a U.S. issued Visa, MasterCard, American Express or Discover credit card issued by or through a financial institution located in the U.S. ("U.S. Bank"). If AFC does not receive authorization from the U.S. Bank issuer, the transaction will not be processed. Each time You submit a payment, You agree that AFC is authorized to charge Your designated U.S. Bank account for the principal or interest amount, and any applicable U.S. Bank fees. Your agreement with Your U.S. Bank issuer governs use of Your U.S. Bank card, and You must refer to that agreement to ascertain Your rights and liabilities as a cardholder, which may include a "cash advance" fee.

PAYMENT BY ELECTRONIC CHECK. You may submit your payment by electronic check from a checking or savings account held in Your name at a financial institution in the United States ("U.S. Bank Account"). AFC may use the Automated Clearing House network in order to initiate the electronic transfer from Your U.S. Bank Account. Each time you submit a payment by electronic check You agree that AFC is authorized to initiate electronic payment and/or make any corrections to complete the payment from Your U.S. Bank Account.

REFUND POLICY. Payments submitted will be applied to your outstanding balance in accordance with the terms of your Association’s governing documents. Requests for refunds for overpayments must be submitted in writing to:

Requests for refund must include your full name, account number, permanent legal address and contact information where we may contact you.

CANADIAN CUSTOMERS. If Your assigned account is located in Canada, You may submit your payment using a credit card issued by or through a financial institution located in Canada ("CN Bank") ("U.S. Bank" and "CN Bank" are collectively referred as "Bank"). Payments will generally be accepted in local currency. Note, AFC may not accept a currency different from the national currency of the country of your account, or may charge an additional fee.

DOCUMENTATION. Your Bank statement will reflect any payments processed via the AFC Website by the assigned account name. A payment history will be made available to You on the AFC Website the next business day after Your transaction is processed. Payments will generally be posted to Your account within approximately three (3) business days (Monday – Friday, except holidays.) You should print and retain a paper or electronic copy of Your payment history for Your records.

TEXT MESSAGE POLICY. By providing your cell phone number, you have provided us with consent to send you text messages in conjunctions with the services you have requested. Your cellular provider’s Msg&Data Rates may apply to our confirmation message and all subsequent messages. You understand the text messages we send may be seen by anyone with access to your phone. Accordingly, you should take steps to safeguard your phone and your text messages if you want them to remain private. NO CONFIDENTIAL INFORMATION SHOULD BE SENT VIA TEXT MESSAGE. Please notify us immediately if you change mobile numbers or plan to provide your phone to another person. If we modify this Text Message Policy, we will notify you by sending you a text message with a link to the new policy. We may terminate our text message program at any time. If you have any questions about this policy, would like us to mail you a paper copy of this policy or are having problems receiving or stopping our text messages, please contact us. You agree and consent to be contacted by AFC, our agents, employees, attorneys, affiliates, subsequent creditors, loan servicing companies, and third-party collectors through the use of email, and/or telephone calls and/or SMS text messages to your cellular, home or work phone numbers, as well as any other phone number you have provided in conjunction with this account, including the use of automatic telephone dialing systems, autodialers, or an artificial or prerecorded voice.
Opt-out or STOP.
This policy applies to the text messages sent to our customers while and after they use our product. If you wish to stop receiving marketing text messages, reply to any text message we have sent you and in the reply text simply type STOP. If you wish to stop receiving all text messages, including those with information about payment due dates or missed payments, type STOP ALL in the reply text you send us. Your stop request will become effective within one business day. You may also stop text messages by calling us or emailing us using the contact information below.
Help or Support. If at any time you need our contact information or information on how to stop text messages, reply to any text message we have sent you and in the reply text simply type HELP. Upon receiving your text message, we will send you a text message with this information. It is our policy to send no more than five (5) messages per month. In general, the messages we send provide you with information about your account. Some of the text message we send may include links to websites. To access these websites, you will need a web browser and Internet access.

AFC RELIANCE ON INFORMATION YOU PROVIDE. You are responsible for the content and AFC may rely upon the information You provide when processing the transaction. AFC may rely solely on the account numbers that You provide for identifying Your Bank Card and if applicable the routing numbers that You provide for identifying Your U.S. Bank Account. AFC is not responsible for detecting any errors in payment by Bank. You represent to AFC that You are the owner of the Bank account and have all necessary authority and rights to register and to initiate an electronic funds payment. AFC may rely on your representation and the authorization without investigation.

LIMITATIONS OF LIABILITY. IN NO EVENT SHALL AFC BE LIABLE FOR DAMAGES WHETHER CAUSED BY NEGLIGENCE ON THE PART OF ITS EMPLOYEES, SUPPLIERS OR AGENTS OR OTHERWISE, BEYOND THE SUM OF $500. IN NO EVENT SHALL AFC OR ITS AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR THE LIKE.

INDEMNITY. You agree to indemnify, defend and hold harmless AFC, and all its officers, directors, owners, agents, employees, affiliates, licensors, licensees and third party service providers (collectively, the "Indemnified Parties") from and against any and all losses, damages, liabilities, and claims and all fees, costs, expenses of any kind related thereto (including, without limitation, reasonable attorneys’ fees) incurred by the Indemnified Parties in connection with any claim arising out of, based upon or resulting from (i) Your access to and/or use of the AFC Website including, without limitation, the money transfer services; and/or (ii) Your violation of the Terms and Conditions. AFC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by You. You are not authorized in any event to settle any matter without the written consent of AFC.

INTELLECTUAL PROPERTY. The AFC Website, the content and all intellectual property pertaining thereto and contained therein (including but not limited to authors, database rights, trademarks and service marks) are owned by AFC or third parties, and all right, title and interest therein and thereto shall remain the property of AFC and/or such other third parties. You are authorized solely to view and retain a copy of the pages of the AFC Website for Your own personal, non-commercial use. You may not duplicate, publish, modify, create derivative works from, participate in the transfer of, post on the web, or in any way distribute or exploit the AFC Website for any public or commercial use without the express written consent of AFC. You further agree not to remove or alter any author, trademark or other proprietary notice or legend displayed on the AFC Website (or printed pages thereof). "Advanced Financial Company," "AFC," and "Premier Advanced Financial Corporation," are the exclusive marks of AFC.

LINKS TO OTHER SITES. The AFC Website may contain links and pointers to other Internet sites and resources (the "Linked Sites"). Links to any Linked Site do not constitute an endorsement by or association with AFC or any of its affiliates to any third party resources or their contents.

GENERAL. Information provided to AFC shall be truthful and complete. AFC and its Agents may refuse to provide Services to any person.

STATEMENT OF YOUR LIABILITY. Notify AFC immediately if You believe Your AFC account online authentication has been lost or stolen or if someone may use them without Your permission.
If Your Bank Account statement shows AFC debits that You did not authorize, notify AFC immediately.
